1️⃣ The legal context (what the law requires of us)
As a guesthouse registered with CADASTUR, we are legally required to register every guest who stays with us. This obligation derives from several legal texts:

2️⃣ What concretely changes for us
👉 Paper forms are no longer compliant. Establishments still using physical forms are in breach of the regulations in force.
The new digital National Guest Registration Form (FNRH Digital) has become mandatory in all lodging establishments in the country. The tool, developed by the Ministry of Tourism in partnership with the Federal Data Processing Service (SERPRO), definitively replaces the paper model and modernizes the check-in process in hotels, guesthouses, resorts and hostels.
⚠️ Important: the FNRH Digital must be adopted by all lodging establishments in Brazil, including hotels, guesthouses, hostels, resorts, flats and similar. There is no distinction between a large resort and a small guesthouse.
3️⃣ The risk if we fail to comply
Per the Ministry of Tourism's determination, all establishments registered with CADASTUR that fail to implement the FNRH Digital are subject to administrative proceedings and penalties. Sanctions can range from formal warnings to fines, depending on the severity and recurrence of the infraction.
In addition, non-compliant establishments may have their data submission blocked, and failure to adapt may generate administrative proceedings — which directly impacts our operation.
4️⃣ Our pragmatic strategy (the "vital minimum")
The complete FNRH is theoretically mandatory in its entirety, but to avoid driving away a guest tired from travel while still remaining legally protected, here are the 4 non-negotiable pieces of information we must keep:
- Full name
- CPF (Brazilians) or Passport (foreigners)
- Why: without the CPF, we cannot issue the Nota Fiscal (tax invoice). In the event of a payment dispute (credit card chargeback), it is our only defense.
- Phone / WhatsApp
- Why: communication during the stay, sending the invoice, integration with the PMS.
- Arrival date + expected departure date
- Physical or digital signature
- Data protection law consent statement just above
💡 What we can "trim down" (at our own risk)
Many small guesthouses skip: full address (often just City + Country), profession, origin / next destination, means of transport.
5️⃣ ⚠️ The absolute exception: MINORS
Even in the simplified version, no exceptions are possible when a minor accompanies the adults. The Brazilian police are uncompromising on child trafficking and exploitation. We must require the child's ID document to prove filiation, or require the signed travel authorization.
The law explicitly provides for this: in situations involving minors under 18 or legally incapable persons, the registration is linked to the FNRH of the legal guardian.
6️⃣ ✅ What I propose as next steps
No need to do everything today, but soon we will need to:
- Stop using paper forms and migrate to the digital system.
- Activate the FNRH Digital linked to our CADASTUR account via gov.br. For lodging establishments, an active CADASTUR account and a gov.br account are required. Each guest will have an individual form linked to their stay.
- Implement a digital Pre Check-in: a link sent by email or WhatsApp a few days before arrival. The guest fills everything out comfortably on their phone. Upon arrival → simple visual ID validation + signature. The main advantage is allowing travelers to complete the pre check-in digitally even before arriving on site, avoiding queues and saving precious time.
- Renew CADASTUR every year before March 31, otherwise the registration is suspended.
the law (11.771/2008 + Decree 7.381/2010 + Ordinances 28/2025, 41/2025 and 4/2026) requires us to switch from paper to digital. The longer we wait, the more we expose ourselves to fines and to having our CADASTUR status blocked. The simplest and most comfortable solution for guests is online pre check-in before arrival.

Règlement & Horaires
- Lei nº 11.771/2008 Art. 23, §4º : Les horaires d'entrée et de sortie sont définis par le règlement de l'établissement.
- La "diária de 24h" n'est PAS absolue — il faut soustraire le temps nécessaire à l'hygiénisation et à la préparation de la chambre.
- Le check-in tardif (ex: 20h) n'oblige PAS la pousada à étendre le check-out.
- Le check-out DOIT être fait au plus tard à 12h00.
- Si le client souhaite rester plus tard → consulter la disponibilité et appliquer le tarif "meia diária" (demi-journée) ou "diária adicional" (nuit supplémentaire).
- Les chambres doivent être libérées pour la préparation (nettoyage, draps, linge) pour les prochains clients.
- ⚠️ Si le client dépasse l'heure de check-out sans autorisation, la pousada se réserve le droit de libérer la chambre pour les clients suivants.
- Gratuit pour les enfants de <6 ans
- R$ 10 pour les enfants de 6-12 ans
- ⚠️ NON inclus dans le tarif de la chambre (sauf réservations Airbnb)
